Today 99.9% of those living in Crimea are under the Criminal Code of Ukraine article on collaborationism.
Most residents of Crimea are not traitors to Ukraine. And the definition of “collaborationism” for the peninsula needs to be changed, taking into account the details of its long-term work. This was said by the head of the prosecutor’s office of the Autonomous Republic of Crimea and Sevastopol Igor Ponochovny, Interfax-Ukraine reports on Monday, March 6.
“In my opinion, most of those who stayed there (in Crimea – ed.) were not traitors. It is more difficult to determine whether they were collaborators,” he said.
The prosecutor noted that now 99.9% of those living in Crimea are under the article of the Criminal Code of Ukraine on collaborationism, which appeared in the spring of 2022.
“I think this article is more focused on those who find themselves under occupation after February 24, 2022, it was written without taking into account the details of the long-term occupation of Crimea,” Ponochovny believes.
He explained that the Ukrainians who stayed on the peninsula worked, did business, and studied.
“All these years we have been talking to the Crimeans, explaining that they are not traitors, a significant part of them are victims of the armed conflict,” the prosecutor stressed.
In his opinion, an article about collaborationism without considering the details of the long-term occupation of Crimea is quite dangerous, and Russia is manipulating it.
“Earlier the occupiers told the Crimeans not to go to the mainland of Ukraine, because they are considered traitors there and they will be imprisoned. Now the enemy, referring to the article on collaborationism, is telling the Crimeans that they cannot have to go to Ukraine and Ukraine does not have to go to Crimea either, because everyone will end up behind bars,” explained Ponochovny.
He noted that the prosecutor’s office of the Autonomous Republic of Crimea has repeatedly raised the issue of changing the definition of “collaborationism” in the context of Crimea in different areas, the position of the prosecutor’s office is shared by non-governmental organization and the presidential office in the Autonomous Republic of Crimea.
Speaking about what exactly should be changed in the article of the Criminal Code, the prosecutor explained: “I think it makes sense to supplement the article by indicating the purpose of cooperation with the occupying authorities, for example, “to strengthen defense capability of the aggressor state.”
At the same time, according to Ponochovny, the changes in this article should be approached in a balanced way, “because they can provoke a certain excitement – a review of the sentences for those who cooperate in the territories liberated from occupation. “
