Sergio Tarache Parra, accused of murdering Catherine Gomez, was detained by Colombian police last Tuesday evening. However, his extradition to our country to answer for this crime seems to be becoming a new obstacle on the path to restoring justice.
In this regard, the chairman of the judiciary Javier Arevalo, In press statements, he indicated that the extradition process has already begun with the Colombian authorities and that there will be no grounds for the president of this country in this process, Gustavo Petroto intervene to prevent the transfer of Tarache to Peru.
“Lord Sergio Tarache He has a warrant for his arrest. It is being processed for delivery to Peru and I believe that I wouldn’t have a reason the president of Colombia (…) to intervene to prevent the extradition of this person who committed the crime,” he said.
“I don’t know how the Colombian authorities are handling this issue, but he must return to Peru to answer for the crime he committed,” he added.
The decision of the Colombian authorities
With regard to the extradition process, the President of the Judiciary indicated that it was a procedure that had its own procedures and that it was preferable to exile.
“I understand that Mr. Tarash has been detained in Colombia and that there are two possibilities: extradite him or expel him. (…) I don’t think it should be excluded Venezuela, since he has a criminal record here in Peru, there is a request for his transfer. If a person were extradited to his country, he would not have to answer,” he said.
However, it states that the final decision on the procedure lies with the Colombian judiciary.
“As a rule, people who illegally enter the territory are expelled. It is my understanding that this gentleman entered Colombia illegally. unusual, but this is already in line with the Colombian authorities, let’s not lose sight of it. It is up to the Colombian authorities to decide whether to deliver or not,” he said.
“Colombia This is a country that also has a judiciary and a prosecutor’s office that deals with these issues. We cannot say that they will do what we say. For the sake of reciprocity and because there is a criminal act, they must agree to the request of Peru, but this is a different country,” he added.
Regarding a possible life sentence for Tarache Parra, President Power of attorney pointed out that it would depend on the judges who hear the case.
“The judges will see if it is a life sentence or what the sentence is. I cannot interfere with this, but the judges who will try this person will see what the verdict is, if there is one,” he said.
The judge pointed out that the Peruvian justice system could guarantee due process, especially in the case of a crime as heinous as femicide.
“It’s totally guaranteed impartiality judges and due process, but I also believe that due process will, in due course, demonstrate the effectiveness of criminal sanctions, how criminal justice responds to an act that we all need to condemn,” he said.
