The European Business Association (EBA) wrote to the government in an open letter asking to postpone the introduction of mandatory automated pollutant emission control systems, as described by the draft regulation of the Ministry of Environmental Protection.
According to the association, currently, the business does not have 5.8 billion hryvnias for the necessary equipment, and if the project is implemented, such equipment risks falling under enemy fire and being destroyed.
“The war creates many factors that complicate the practical implementation of the requirements of the draft resolution. First, the installation of automatic surveillance systems in facilities that are always at risk of being damaged by enemy strikes or waiting for reconstruction / decommissioning is not economically feasible. Secondly, there are certain difficulties in attracting significant investments, importing equipment and finding contractors to carry out work in conditions of high which is a security risk,” the appeal said.
EBA experts stressed that in fact the draft regulation proposes an approach based on Directive 2010/75/EU on industrial emissions, which, among other things, should introduce new European environmental standards – conclusions of the best available technologies and management practices (BAT) .
“Automatic emission monitoring systems are only one element of industrial pollution reform. BAT conclusions determine whether a particular installation requires automatic monitoring and what are the requirements for it. Therefore , it makes sense that, first, it is necessary to develop a legislative framework for the comprehensive implementation of Directive 2010/75/EC, publish and approve, as provided by the Seville process, BAT conclusions, and only after installing of automated monitoring systems in reconstructed facilities,” the authors of the document write.
The Association also drew the fact that the industrial enterprises of Ukraine suffered greatly from the fear of Russia, and some of them stopped completely because of the war.
“During the 9 months of the war, the metallurgical industry lost more than 50% of its potential, more than half of the energy infrastructure facilities were damaged or destroyed: at least 1.5 billion euros are required for restoration of surface energy facilities only. Now there is no talk of industrial restoration – first of all, companies are trying to in addition to the ongoing humanitarian aid and support for the Armed Forces of Ukraine, to ensure the minimum important activities of businesses in the face of the constant threat of missile attacks. The business community greatly appreciates the latest regulatory changes aimed at supporting business in the form of deferring the strengthening of environmental requirements and tax exemption, and hope that the implementation of the idea of mandatory installation of expensive equipment in measurement worth about UAH 5.8 billion on obsolete and semi-destroyed facilities will still be postponed to the stage of post-war reconstruction,” the authors of the letter quoted the coordinator of the committee for industrial ecology and sustainable development. of the European Business Association Olga Boyko.
