The Verkhovna Rada of Ukraine, in the best behind-the-scenes traditions, quietly removed the possibility of confiscating property from corrupt officials, who, according to the new law, can avoid prison by concluding an agreement with the investigation.

    .

The head of the Anti-Corruption Committee of the Verkhovna Rada, Anastasia Radina, announced this on November 25.

The law adopted on November 20, depriving state awards for popularizing the aggressor state, included the replacement of Art. 77 of the Criminal Code. This replacement removed confiscation as a punishment for corrupt officials.

Radina stressed that these changes were unexpected and she would immediately submit a bill to urgently correct the situation.

On November 22, Ukrainian President Vladimir Zelensky signed a decree depriving 34 people of state awards – former people’s deputies, ministers, politicians, singers and others.

The Anti-Corruption Center noted that an important part of the reform with the investigation lasted “up to 20 days.” The reform was part of the requirements for receiving 4 billion euros from the EU. On November 20, the Rada adopted presidential law No. 4074-IX on depriving collaborators of state awards, and on October 29, the Verkhovna Rada adopted European integration law No. 4033-IX on plea agreements for those accused of corruption.

Doctor of Legal Sciences Yuriy Ponomarenko was the first to notice the legal conflict. Two days ago he wrote about this on his Facebook. on the possibility of confiscation of property of corrupt officials.

Thus, part 2 of Art. 77, which provided for the possibility of using confiscation of property upon release from serving a sentence with probation in the event of conviction on the basis of a plea agreement for a corruption or corruption-related criminal offense, remained in force for only 20 days. from 01.11.2024 until November 20, 2024,” he noted.
