California Court of Appeals for the Ninth Circuit rejected this Wednesday a request by former President Alejandro Toledo to suspend his extradition to Peru, which was approved at first instance by Judge Thomas Hickson.
The courtroom rejected the arguments of the defense of the ex-president, who argued that a warrant from the prosecutor’s office should be issued for the crimes attributed to him.
“Toledo demonstrated the existence of irreparable damage, but not the likelihood of success on the merits or that the public interest favored suspension. Therefore, we refuse to issue a suspension. Application for suspension denied,” the document issued by the authorities reads. USA.
The Northern District of California court, which is handling his extradition, also denied him last March. Alexander Toledo a similar request to temporarily suspend their repatriation.
Toledo Manrique has a request for pre-trial detention for receiving about $34 million from the Brazilian construction company Odebrecht through a network of tax haven companies through which he purchased property in Peru for a million dollars.
The former president was being investigated for money laundering, conspiracy and influence peddling in connection with contracts awarded to Odebrecht for the construction of an interoceanic route between Brazil and Peru.
In September last year, US justice gave the go-ahead for his extradition to Peru, finding sufficient evidence to justify the measure, although the final decision rested with US Secretary of State Anthony Blinken.
US allows extradition
The National Attorney’s Office announced on its social media on February 21 that it had become aware that the US State Department had authorized the extradition of former President Alejandro Toledo Manrique, who is under investigation on charges of conspiracy and money laundering.
In this regard, they indicated that the Department of International Judicial Cooperation and Extraditions of the Prosecutor’s Office is coordinating with national and foreign authorities for the upcoming implementation of their extradition.
Former President Alejandro Toledo faces two tax charges against him: 20 years and 6 months in prison and 16 years and 08 months in prison for the Southern Inter-Ocean Highway Sections 2 and 3, in addition to Ecoteva.
The decision of the US Department of State confirms the presence of elements of evidence that allow to remove the suspicion of political persecution against Toledo, since this is a prosecution for the evidence found.
