Halfway through Thursday night, the House unanimously voted in favor of a bill aimed at improving care for women who have experienced miscarriage. Now the text must be examined in the Senate.

Between Wednesday and Thursday night, the National Assembly unanimously voted on a bill to better support women after a miscarriage, with psychological support and sick leave without waiting days. Adopted in the first reading, this text, which was initiated by the MoDem deputy, member of the presidential majority, Sandrine Joso, must now be examined in the Senate.

In the amendment, the government added a measure that had already been revealed by Elizabeth Bourne in an interview with the magazine. HE: Definition of paid sick leave without a waiting day for a woman who has had a miscarriage, unlike traditional sick leave.

This “elimination of the defect will take place as soon as possible and at the latest”, on January 1, 2024, Health Minister Francois Brown emphasized. Environmentalist Marie-Charlotte Garin and several left-leaning elected officials have called in vain for an “additional tool” — three days of specific leave in the event of a miscarriage, leaving women to choose between this leave and sick leave. A few majority votes were in their favor. Sick leave “allows us to guarantee confidentiality”, particularly with regard to the employer, replied Francois Brown.

In opening debate, MP Sandrine Jossot returned to the traumatic and “unfairly trivialised” experience of abortion. She said that one in four pregnancies end in miscarriage, and one in ten women face this ordeal in her lifetime.

Our health care system does not leave enough room for women’s health

Francois Brown, Minister of Health

The text created by each Regional Health Agency (ARS) from September 2024 is “an abortion course that brings together medical professionals, hospital and liberal psychologists” so that women and their partners are informed and systematically oriented.

The bill also allows midwives, not just doctors, to directly refer their miscarriage patients and their partners to a health insurance-approved psychologist. This orientation will take place within the framework of the already existing “MonParcoursPsy” device, which allows access to sessions with a psychologist with the support of health insurance and supplementary health.

Minister Francois Brown felt that “our health system does not leave enough room for women’s health, this must change. (…) Spontaneous abortion is an intimate drama.”
