Nokia launched a campaign to validate its patents against Chinese giant Oppo after filing complaints in India, France, Germany and the UK; a process that a Finnish telecommunications company carries out after the expiration of an agreement signed by both companies in 2018. The last step was to achieve blocking in Germany to sell products from Oppo and OnePlus, after filing 24 lawsuits in Germany.
The District Court of Mannheim ruled in favor of nokia in his recent patent dispute with Oppo and thanks to this, he was able to win the 4G and 5G SEP (Standard Essential Patents) patent lawsuit, with seven transactions filed in Munich and six in Düsseldorf.
According to IAM Media, Oppo called the decision “shocking” and accused Nokia of violating its “F/RAND” (fair, reasonable and non-discriminatory) commitments to intellectual property rights.
Nokia and Oppo: case in court
According to the leaked details of the contract signed nokia and oppo in 2018, a Chinese company is required to pay for the use of patents nokia 3 euros for each smartphone sold, including patents from a Finnish company. According to the leak, the contract was supposed to end in June.
The issue appears to be centered on the patent price that must be agreed upon in order to renew the contract. Both sides will insist on giving preference to their treasury, and this “pull and release” has happened in different cases of pressure.
nokia claims that they “There were negotiations to extend our patent licensing agreement with OPPO, but unfortunately they rejected our fair and reasonable offers. Litigation is always our last resort and we have offered to participate in an independent and neutral arbitration to resolve the issue amicably. We continue to believe that this would be the most constructive way forward.”
In its turn, Oppo replied that “respects and protects its own intellectual property rights and the rights of third parties, and strives to cooperate in good faith in the field of patent licenses in the industry. OPPO opposes unfounded requests such as using litigation as a tool.”
Nokia and its patents at Oppo
The charge focuses on 4G and 5G spectrum telecommunications licenses, a package under Nokia’s broad offering in that market that also includes standards for WLAN, 3G and other multimedia technologies with more than 200 licensees.
Oppoin addition to this agreement, is licensed by OZO Audio of nokia, a system built into the Find and Reno line. However, this part is not included in Nokia’s lawsuit.
In the past, lenovo and a luxury car company Daimler had a lawsuit with nokia on patents in the field of telecommunications and extended this process to the European and Asian sites.
Currently Oppo and OnePlus they filed an objection to the decision in Mannheim, so even in this matter there is a long way to go.
