The Constitutional Court recognized for the first time access to electricity as an unlisted social right, emphasizing that in terms of public services, the right to access water is not the only basic need of Peruvians in the country.
In its resolution, the Labor Code states that “life in the modern world requires certain minimum social rights, without which people cannot lead a decent life and develop in society.” Among them, access to drinking water and sewerage, electricity and the Internet.
On the other hand, constitutional Court acknowledges that while the right of access to electricity not expressly enshrined in the Constitution, it can be seen as a right not enumerated under Article 3 of the Magna Carta associated with such values as human dignity and a social and democratic rule of law.
