Second Constitutional Court of Lima said on Tuesday that he based the amparo lawsuit that Sunedu introduced to prevent university counter-reform from becoming effective.

Last week, the plenary session of Congress, at the urging, approved the autograph of a law weakening Suneda’s autonomy. The norm was approved by 72 votes in favour, 39 against and 4 abstentions after the government reviewed the draft, indicating that it was an attempt against university reform.

judgment declared null and void the procedure of a bill that has not yet been promulgated Congress of the Republic. Thus, the dissolution of the current Board of Directors of Sunedu will be suspended.

“Based on a lawsuit filed Sunedu v. Congress of the Republic in the process of amparo against accumulated drafts signed 697/2021-CR, 862/2021-CR and 908/2021-CR therefore nullifies the legislative procedure aimed at changing articles 1, 12, 15, 17, 20 , the first final additional provision of Law No. 30220″, reads the verdict disclosed by the same institution.

The resolution also asks Congress to uphold the content of the decisions rendered by the Constitutional Court and the right to quality university education in the exercise of its legislative function.

What modifications of the counter-reform affect the institution?

This was stated by the Director General of the Center for Public Policy Analysis of Higher Education Jorge Mori. RPP News to the law on the assassination of Suneda, approved at the urging of the Congress of the Republic.

Mori first argued that the new formation of the Board of Directors would deprive Suneda of powers, since it would be the universities that would have the majority and, finally, would make decisions.

“This makes Sunedu independent of the decisions it makes with universities. Now three members of the board of directors will be representatives of universities, and a representative of the College of Professionals will have a majority to elect a new superintendent. (from Sunedu),” he explained to RPP Noticias.

Mori recalled that the Constitutional Court had already declared unconstitutional the way the board of directors was formed.

“I think the big problem is the conflict of interest. He puts the universities as a judge and a party, while the Constitutional Court called it wrong, because the universities could not regulate themselves, ”he said.
