Neon Cunha Law Project advances to guarantee the benefit throughout the State of São Paulo
The Neon Cunha Bill (PL) advances in the Legislative Assembly of the State of São Paulo (Alesp), which guarantees free rectification of documents for trans people in vulnerable situations in the 645 municipalities of São Paulo. On the 12th, the proposal was received by the Constitution, Justice and Writing Committee with a favorable vote from the rapporteur, deputy Caio França (PSB).
O Bill No. 135/2024 It is authored by state deputy Teonilio Barba (PT) and was filed on March 14 of this year. It provides that “the registration of the change of first name and gender classification in the civil registry of transgender people (transvestites, transsexual women and men, intersex, non-binary and gender-neutral), to be carried out before the Civil Registry of Natural Persons officers within the State of São Paulo, it will be free whenever the applicant is unable to bear the costs and fees of the procedure”.
With text written by Paulo Araújo, current President of Casa Neon Cunha, the PL aims to ensure that every trans and transvestite person, regardless of their socioeconomic context, can access their fundamental rights. A municipal law in the municipality of São Paulo was created for the same purpose, but its scope is restricted and does not cover the entire territory of São Paulo.

In 2023 alone, Casa Neon Cunha monitored and paid for the rectification of documents for 85 trans and transvestite people in the metropolitan region of São Paulo. However, due to the costs of the processes, the year ended with 189 people on the waiting list for the service provided by the support house, which does not have public funding to carry out its activities.
Before 2016, the procedure for changing the first name and gender in the documentation of trans people depended on the presentation of reports proving “gender identity disorder”, even a pathology registered in the International Disease Registry (ICD). It is from the story of Neon Cunha, a black, trans, Amerindian woman, independent activist, that the scenario of rectification changes.
Based in São Bernardo do Campo, Casa Neon Cunha serves 18 to 25 people a day with food, social and hygiene space, laundry, bazaar, library and rest space. In addition to work in the field of shelter and structure, the organization is a reference in psychosocial care for the homeless LGBT+ population and has developed its own methodology – the PIA (Individual Service Plan) – to promote the autonomy of beneficiaries.

As it does not have municipal, state or federal public funding, Casa Neon Cunha is supported solely and exclusively by donations from private institutions and individuals, which are sometimes insufficient to guarantee the full functioning of actions and initiatives, harming development. of the people assisted.
