Today, Wednesday, June 29, is the Day of Saints Peter and Paul, which means a holiday for workers in both the public and private sectors.
But not all employees they will rest. In the midst of the economic recovery, various industries will continue to operate as usual.
This means that companies apply the provisions of Legislative Decree 713, i.e. they have to pay extra wages to their employees if they work during holidays.
How much should they pay you?
Legislative Decree 713 specifies that if employees those who work on this holiday should receive three remunerations on this day for one working day: the payment for June 29, which is already included in the monthly salary, and two additional days of remuneration at the end of the month for working on a holiday.
“In other words, those who work on June 29 this year will receive 2 additional days of pay at the end of the month. is not payment three times, because, we repeat, the payment for June 29 is already included in the regular monthly remuneration,” labor lawyer Cesar Puntriano told news agency Andina.
For example, if your monthly salary is SGD 1,500, you earn approximately SGD 50 per day. If you work during a holiday without changing that day off, then you will receive two additional S/50 payments for that day, that is, for one day you will earn S/150.
Other cases
When employee decides to take a day off to rest, your remuneration will not change, since you should be paid for the holiday as if you had worked it, despite the fact that you rested.
But, if the employee and the company decide to agree to work on a holiday with a break on another working day, additional double pay will no longer be formed.
It should be noted that if workers they have a day starting on June 28 and ending on June 29, it is not a rule that they worked on a holiday and they do not receive additional pay.
“If the holiday coincides with the weekly day of rest and the worker works without a replacement rest, he corresponds to the amount indicated above, two additional days of remuneration,” Puntriano added.
For its part, the Lima Chamber of Commerce (CCL) recalled that this additional payment applies to both employees who provide remote work and those who work in person.
In addition, it was stated that if a June worker is on sick leave, which coincides with the first 20 days of rest in 2022, the employer must pay said leave without having worked; but if the break is after the 21st, the employer pays the vacation not as a remuneration, but as a subsidy, which is reimbursed by EsSalud.
