During wartime, the employer has the right to deny leave to an employee if he is involved in work on critical infrastructure facilities.
President Vladimir Zelensky signed the law “On amendments to certain legislative acts of Ukraine on streamlining the provision and use of vacations, as well as other issues.” This is confirmed by data from the website of the Verkhovna Rada.
It is known that on December 21, the bill was returned with the signature of the president, and the law is currently being sent.
The law streamlines the procedure for the postponement of weekends and working days, introduces the possibility to establish in the labor and collective agreement the duration, conditions and procedures for granting additional annual leave; provides for the payment of monetary compensation for all unused days of annual leave on the day the employee is called up for military service during mobilization.
The law increases the general maximum period for granting an employee unpaid leave for family reasons from 15 to 30 calendar days per year.
During wartime, the employer is given the right to deny an employee any type of leave if such employee is involved in performing work at critical infrastructure facilities.
In addition, it is possible to grant leave without pay for the duration of the threat of the spread of an epidemic, armed attack, emergency situation without limiting its duration (by agreement of the parties), and so on.
The document also provides that the annual leave can be divided into parts of any duration, provided that its main continuous part is at least 14 calendar days, not only at the request of the employee, but also also if required by the employer. In this case, the division of the annual leave must be reflected in the leave schedule, agreed upon with the trade unions.
According to the law, leave for the birth of a child must be given within a clearly defined period – no later than three months from the date of the child’s birth. The child’s father, who is not in a registered marriage with the child’s mother, will be granted such leave only after receiving the appropriate court decision. At the same time, permission is given to adopt a child regardless of its age.
The law also provides for military personnel discharged due to demobilization from military service during mobilization with a break for 60 working days with the payment of two months’ salary during mobilization at the expense of the budget of state of Ukraine.
The law also regulates the provision of sabbatical leave, leave to prepare for competitions, and leave related to union training.
Let’s recall that in December 2022, Zelensky signed a law that provides the possibility to grant leave to military personnel during martial law. In June of this year, the Verkhovna Rada supported the bill on military withdrawal, extending it to 40 days.
