On November 7, 2023, the first hearings will take place as part of the consideration of the Disciplinary Tribunal of the International Fencing Federation (FIE) on the complaint of the Ukrainian Fencing Federation regarding the exclusion of the Russian fencing federation from the FIE.
This was reported by the press service of the law firm “Ilyashev and Partners,” which represents the interests of the Ukrainian Fencing Federation.
The Ukrainian Fencing Federation filed a disciplinary complaint regarding the exclusion of the Russian Fencing Federation from the FIE on June 15, 2023, challenging the Russian Fencing Federation’s creation of its cells in the temporarily occupied territories of Ukraine, which is a violation of international law and sovereignty.
After the temporary occupation and annexation of Donetsk and Luhansk regions, the city of Sevastopol and Crimea, the fencing federation, following the instructions of the government of the aggressor country, together with the so-called “regional fencing federations”, located and registered in the temporarily occupied territories of Ukraine.
In its complaint, drafted with the help of lawyers from the law firm Ilyashev and Partners, the Ukrainian Fencing Federation states that such actions by the Russian Federation deprive it of its status as a non-governmental organization, which means that the Fencing Federation becomes a subject of international legal responsibility.
“The Russian Fencing Federation appropriated the legally existing Ukrainian regional fencing federations by integrating them into the structure of the Russian Fencing Federation. Such unconditional execution of orders of the Russian government does not correspond to the declared independent and non-governmental status of the fencing federation, – emphasized the Fencing Federation of Ukraine. – This implies that the fencing federation is fully controlled by the government, and therefore should be considered as a structural subdivision of the Russian government.“.
The Ukrainian Fencing Federation requests the FIE to exclude the Russian Fencing Federation from its membership and suspend it from participating in any events related to the field of fencing under the auspices of the FIE.
Let’s recall that earlier the law firm “Ilyashev and Partners”, in the interests of the Fencing Federation of Ukraine, filed a complaint against the International Fencing Federation to the International Olympic Committee (IOC) through the actions of the International Fencing Federation that aimed at the return of Russian and Belarusian fencers to participation in international competitions.
