The US Department of Justice is appealing the Florida District Court’s decision to dismiss the case against former President Donald Trump for storing classified documents at his residence. It was reported by Reuters.
Judge Eileen Cannon ruled that special prosecutor Jack Smith, who announced the indictment against Trump, was illegally appointed to his position and therefore did not have the authority to accept the charges.
In this regard, Smith’s press secretary said that Judge Cannon’s decision “deviates from the consistent conclusion of all previous courts” that have considered this issue. Courts continue to hold that the attorney general has the authority to appoint a special counsel to conduct certain investigations.
The US Department of Justice said it would appeal the decision.
