This court abolished sanctions against Yanukovych for corruption. he motivated the decision by the fact that the EU Council, before imposing sanctions against Viktor and Alexander Yanukovych in 2021, did not check whether these two had the opportunity to exercise the right to defense.
The same decision was made regarding Yanukovych’s son Alexander, former Prosecutor General of Ukraine Viktor Pshonka and his son Artem.
The documents were published in the official journal of the EU.
The 2014 sanctions were imposed on the basis of a criminal case brought against Yanukovych in Ukraine on charges of theft of public funds and their illegal movement outside the country.
The EU court ruling states that during the criminal trial against Yanukovych and Pshonka in Ukraine, the right of the accused to effective judicial protection was not respected.
At the same time, restrictions remain against Yanukovych and his son as part of another package of EU sanctions. They were introduced against them after Russia’s invasion of Ukraine with the wording “for their role in undermining or posing a threat to the territorial integrity of the country.”
In January 2019, a court in Kyiv sentenced Yanukovych in absentia to 13 years in prison on charges of high treason and complicity in the resolution of an aggressive war.
