The concept of “digital objects” includes: virtual assets, digital content, online accounts, digital currency and securities.
The Verkhovna Rada generally adopted two draft laws No. 6447 and No. 6576, which defines virtual assets and digital content as objects of civil law. This means that they are subject to the regulation of the Civil Code, Interfax-Ukraine reports.
For them, in the plenary session on August 10, 271 and 277 votes were cast, with the required minimum of 226.
The explanatory note states that it is proposed to increase the basic fee in Art. 177 and 179-1 of the Civil Code of Ukraine with the concept of “digital things”. “Digital things” include virtual assets, digital content, online accounts, money and securities that exist only in digital form.
In addition to defining the range of “digital objects”, the draft law defines the main postulates of the legal regulation of the circulation of the property of “digital objects” and fixing the possibility of expanding the provisions on things of the material world in “digital things” .
According to the European integration bill No. 6576, the scope of civil relations is defined, the subjective and objective criteria for compliance of digital content (services) with the terms of the concluded agreement are chosen, the legal consequences of not providing digital content (services) under the agreement, as well as non-compliance with the content (services) is established.
The grounds and legal consequences of the refusal of the contract, according to which the digital content (service) is provided, are also determined.
Recall that the Verkhovna Rada adopted in the second reading the draft law No. 5431 On Amendments to Certain Legislative Acts of Ukraine to Improve the Activities of the Antimonopoly Committee of Ukraine. The document provides for improving the efficiency of the system for the development and protection of economic competition, improving the state policy in the field of protecting economic competition, strengthening the institutional capacity of the AMCU and is developed in accordance with the requirements of the article of the Association Agreement with the EU.
