Supreme Court of the Canary Islands, Spain, announces dismissal teleworker who was called during the day not to serve customers.
The case dates back to October 2020 and has only recently been clarified with the help of the relevant structures: with his actions, he also harmed his colleagues.
Here’s how the remote worker acted
The employee has been providing services to a computer support company since 2019.
In October 2020, an employee received a disciplinary termination letter for not answering customer calls and was accused of using a fraudulent strategy.
This document describes that the employee made 150 calls to his number to avoid requests from the company’s customers: he called himself to be redirected to another employee.
The total duration of the calls was 22 hours and 40 minutes.
“This attitude was not a one-time event, but repeated continuously month after month, and with varying frequency of these calls, therefore it manifested itself in fraud, disloyalty and abuse of trust of the entrusted efforts,” refers to the document. “While your job is to serve customers and resolve incidents, you have knowingly and repeatedly falsified data by not serving customers who hire us to provide services to them and for which we charge.”
Justice speaks
In July 2023, the Social Court No. 4 of Santa Cruz de Tenerife dismissed the claim filed by the worker. To the judge, his behavior was typical of “fraud, disloyalty and breach of trust”. In addition, he harmed his colleagues by overworking them.
Now the Supreme Court of the Canary Islands has dismissed the worker’s renewed appeal, saying his dismissal is “proportionate and proportionate to the seriousness of the acts committed.”
