Dean of the Lima Bar Association (LIME), Cesar Bazan Naveda, believes that “the leadership was formed” in the executive branch in order to interfere with the investigative function of the “prosecutor’s office and “disappear evidence” that could concern the president Peter’s castle in committing a crime.
In an interview with News extension from PTRindicated that Minister of State Patricia Benavidez filed a constitutional complaint against the head of state in the Congress of the Republic for alleged criminal organization crimes, influence peddling and conspiracy to allow her to continue the investigation.
“But the problem arises in Article 117 of the Constitution, which only allows filing complaints in four specific cases,” said the dean of the Lima Bar Association.
“You can’t protect absolutely anyone”
According to this rule, the president “may be accused only during his term of office of high treason; for obstruction of presidential, parliamentary, regional or municipal elections; to dissolve the Congress, except as provided in Article 134 of the Constitution, and to prevent its convocation or work, as well as the National Jury for Elections and other bodies of the electoral system.
According to Cesar Bazan, this article of Magna Carta “cannot drive us to the point of absurdity”. “What’s so absurd about that? In this case: that we have a person who is under investigation, that sufficient grounds have been found to believe that he has committed a crime, but that he cannot be punished; that is, it will allow not to judge a person who may be a criminal, ”he said.
“[La fiscal de la Nación] It is not unfounded in the sense that absolutely no one can be protected, least of all someone who performs a public function that may allow him or her to hide evidence, ”he added.
