In the previous court, the judiciary declared inadmissible the complaint filed by the lawyer last Wednesday, August 31, against Judge Johnny Gomez and National Attorney Patricia Benavidez to file a case.
In his motion, the lawyer asked for his client’s release, warning of an alleged violation of the right to “have a natural judge” and the right to “not be discriminated against for political reasons.” However, Judge Jorge Valencia, who originally considered habeas corpus, dismissed the charge.
Now Superior Court of Lima it was established that “such an interrogation must be carried out previously within the framework of the same criminal process and with the exhaustion of appeals established by the criminal procedure law before applying to the constitutional process.”
“Counsel’s allegations represent controversies that go beyond the defense of habeas corpus and involve issues pertaining to ordinary criminal proceedings. Therefore, it is advisable to declare the claim inadmissible. […]since the facts and the petition do not directly relate to the constitutionally protected content of the right,” the resolution established.
Yennefer Paredes is serving 30 months of pre-trial detention
On August 28, the Third Preparatory Court of Inquiry of the National High Court of Specialized Criminal Justice (CSN) sentenced Yenifer Paredes to 30 months of pre-trial detention.
A special group of the public ministry is investigating the cases of Yenifer Paredes and Nenil Medina, the mayor of the district municipality of Angii, on suspicion of a criminal organization. The First Lady’s sister, Lilia Paredes, is serving preventive detention at Chorrillos Women’s Prison.
