Dean of the Bar of Lima (CAL) Cesar Bazan Naveda today dismissed constitutional complaint submitted by the Free Peru Board against the National Prosecutor, Patricia Benavidezas part of the investigations carried out against President Pedro Castillo and his family circle.
In an interview with Expansion de Noticias RPP NewsBazan denied that the head of the State Ministry (MP) was abusing power in the midst of an investigation launched against the head of state, as condemned by the ruling party.
He noted that Patricia Benavidezas Attorney of the Nation, acts in accordance with the law and his constitutional powers.
“There is no abuse of power by the prosecutor. [de la Nación], it has the authority to conduct relevant investigations. The facts brought by the prosecutor’s office are correct and are within the law,” he stressed.
In this sense, he called it laughable that a Serronist group claims to be “abusing power” in order to interfere with the investigation of the head of parliament.
“… it is not clear how they invent so many arguments and other [abogados] they see it as fun, because arguments are being tested that will fail in relation to the abuse of power. It’s funny that someone can be heard in this sense, ”he said.
The complaint must indicate Patricia Benavidez being interrogated for the “abrupt and arrogant dismissal” of Interim High Prosecutor Bersabet Felicitas Revilla Corrales, who was investigating Senior Judge Emma Benavidez, sister of the country’s prosecutor, on suspicion of bribery and illegal conspiracy to commit crimes in the form of a criminal organization.
Is it right that a criminal organization is at the heart of the investigation into the president’s entourage?
On the other hand, Bazan Naveda said that the term “criminal organization”, which would involve the inner circle of President Pedro Castillo, is well used in the framework of the tax investigation.
He added that if Benji Espinoza, the president’s lawyer, doesn’t like the term, that’s “another matter.”
“This is a criminal organization, if you don’t like the term [a Benji Espinoza] that’s a different topic. There are people who commit crimes alone … but if a group of people that we used to know as a gang gathers and organizes to commit crimes, then this is an organized group, ”he explained.
“They call by name, they don’t say that such and such is to blame; it only talks about criminal modality,” he said.
Stamps found in Yenifer Paredes’ house have no explanation
Another time the owner LIME ordered the discovery of a total of 14 seals lieutenant governors from various communities and the justice of the peace of the district of Angia at the home of Yenifer Paredes in Chota (Cajamarca) following a raid by the prosecutor’s office on 10 August.
In this regard, he stated that the seals should be kept exclusively by civil servants, to which he stated that he did not understand why these seals were in the residence of the president’s daughter-in-law. Peter’s castle.
“There is no possible explanation, because the seals must be in the hands of state officials and authorities. [Los sellos] they cannot leave them anywhere else, because legal certainty is based on the duty of an official to put his signature, read the documents and put his seal,” he specified.
“[Supongamos] I am a notary and this is happening [la Fiscalía] raid the RPP and they will find my seals, why should the seals not be in the place where the official is?” he criticized.
