Lawyer Benji Espinozalegal defense of the president Peter’s castletold the press today that the head of state was called by the prosecutor’s office to testify in cases of alleged illegitimate promotions in the PPP and the military, and alleged obstruction of the capture of fugitives Juan Silva and Fray Vasquez.
“There are two dates. The first declaration is scheduled for August 4 and the second, for the case of concealment, August 9. Both in the morning,” he said.
Whether national prosecutor Patricia Benavidez will go to the Government Palace or the president will go to the public ministry headquarters remains to be determined, the lawyer said.
new investigations
Recall that during this month the National Prosecutor’s Office decided to initiate new preliminary investigative actions against the President of the Republic. On July 14, it involved the president in an investigation into the alleged promotions of officers of the Armed Forces and the National Police, attributing to him leadership of a suspected criminal organization who interfered in this wrong process.
Similarly, on July 21, Patricia Benavidez decided to initiate preliminary investigation for 60 days for the alleged crime of personal concealment to the detriment of the state, upon departure Mariano Gonzalez Ministry of the Interior (Mr.minter).
Despite these new tax investigations, Benji Espinoza argued that the defense position “Stays the same” regarding the suitability of the procedure.
“To the President of the Republic he cannot be subjected to investigation during the entire term of his office, except for the high treason case, which is not under the jurisdiction of the public ministry,” he said.
Request to withdraw from Kolchado
On the other hand, the president’s lawyer referred to Work from Minister of the Interior to Senior Prosecutor Marita Barreto requesting the resignation of PPP Colonel Harvey Colchado from the PPP Task Force to support prosecution.
“A system of police prosecution which, having received a firm and valid judicial mandate, enforces it, locates, captures and prosecutes people, can’t be personalized, can’t rely on the surname Colchado (…) This is wrong,” he said.
In this sense, he stated that the “prosecutor” could not determine “who are members special police unit.
“This is not the responsibility of the state ministry. (It) investigates, but does not decide which cops make up such a team. There are others who have as much or even more experience than Mr. Colchado,” he stressed.
Similarly, regarding the trial of former Presidential Secretary Bruno Pacheco, the lawyer said it was “the best evidence” that the government is not obstructing justice.
“The voluntary surrender of Bruno Pacheco proves, confirms and proves that He had no police protection. How can a person who is under the protection of the President surrender voluntarily? (…) This is the best proof that the President is not covering for anyone,” he said.
