Judge Ramiro Salinas Siccia The Third National Court of Criminal Appeals upheld the ruling of 9 April last year, which provides variation house arrest measures against the former president Pedro Pablo Kuczynski (PPK) for limited appearance. The previous judicial regime expired on 10 April.
The move follows the dismissal of an appeal by the former president’s defense, which sought to overturn rules of conduct imposed on him, such as a ban on contact with his co-defendants. Gloria Jesus Kisic Wagner, Jose Luis Bernaola Sufflot D Gerardo Rafael Sepulveda Quesada; a ban on leaving the Metropolitan of Lima without court permission or a ban on making statements to the media about the case.
The restricted appearance against the CPD also establishes that he must go to court every 30 daysto report on their activities.
“All this, with a direct warning that in case of non-compliance with restrictions and a preliminary request, it will proceed to lift the measure, bringing back the status quo of house arrest”, the court said in its decision.
Barrier to leaving the country
In addition, the court upheld the decision made by Judge Jorge Chavez Tamaris ban the PPK from leaving the country for four months after the rejection of appeals filed by both the former president to cancel this measure and the Ministry be extended to 18 months.
In this regard, the Court determined that the measure of Judge Chavez “properly motivated” because said preliminary investigation is nearing completion before the completion of the accounting expertise in the case.
“The Referee makes such precision to indicate that the nature of the measure avoid the absence of a person under investigation in the country so that the investigation of the crime can be carried out optimally,” the decision reads.
As you know, Pedro Pablo Kuczynski faces two more arrests with restrictions and a ban on leaving the country for 12 and 30 months as part of the preparatory investigations that are ongoing in the case of Southern Interocean Highway associated with Odebrecht and financing his 2016 presidential campaign respectively.
