Permanent Criminal Division of the Supreme Court regarded this Wednesday as “satisfied” an appeal filed by the defense of former President Pedro Castillo against a resolution dismissing a previous issue he advanced in order to honor the guarantee of impeachment to the President.
Following this measure, the Permanent Court specified that it would set a date for public hearings in the near future, at which the parties to the proceedings would present their oral reports.
Pedro Castillo is under investigation on charges of rebellion, conspiracy and other crimes to the detriment of the state and society for attempting to coup d’état on 7 December.
On January 27, the Supreme Investigating Court found unfounded in the first instance the investigation’s previous question that Castillo was under investigation for allegedly committing the crimes of mutiny, conspiracy of mutiny and others to the detriment of the government. State and Peruvian society.
Castillo’s appeal seeks to nullify an investigation launched after a self-coup he attempted on December 7, which led to his dismissal by Congress that same day.
Castillo has been in detention since December 7, and a few days later he received a court order for 18 months of pre-trial detention while he is being investigated for a coup d’état.
36 months in prison
The judiciary has ordered a 36-month pre-trial detention for former President Pedro Castillo and former Minister of Transport and Communications Juan Silva, as well as a restricted appearance for former Housing Minister Gainer Alvarado.
Judge Juan Carlos Chekli Soria granted the request of the Prosecutor’s Office of Castillo Terrones to continue in prison the process that is being carried out regarding the alleged crimes of the criminal organization and corruption committed in Petropera and the Ministries of Transport, as well as Housing, Construction and Sanitation.
According to the justice of the peace, the measure is justified by the complexity of the investigation against the former president. He also indicated that he does not have domestic roots, so there is a danger of flight.
This is the second preventive detention given to Castillo Terrones, who already had a previous 18-month detention ratified by the Supreme Court’s Permanent Criminal Division. However, Judge Checkley considered that each measure of restraint imposed on the former president is independent.
Pedro Castillo “absolutely and categorically” denied that he was the author and was a member of a criminal organization, and assured that a castle of alleged crimes was assembled against him with the participation of “purchased accomplices.”
