He constitutional Court (TC) released this Friday the ruling on a jurisdictional lawsuit filed by Congress against the judiciary that is ultimately upheld by Parliament. At the same time, justices of the peace annulled court decisions that allegedly violated the exclusive and exclusive powers of the Legislature.
The verdict formalizes the annulment of the rulings of three constitutional processes: the measures that suspended the process of electing an ombudsman, the measures that prevented parliamentary investigations into matters of public interest, and the ruling that halted university counter-reform.
He constitutional Court also provides for notification National Council of Justice on the “functional conduct of judges who intervened in amparo constitutional proceedings affecting the powers vested in the Congress of the Republic, so that it could institutionally evaluate these facts in accordance with its powers.”
Finally, the Constitutional Court asks Parliament to amend Article 99 of the Political Constitution of 1993, and amend its provisions in accordance with this ruling and the practice of the Constitutional Court.
According to this article of the constitution, the Permanent Commission may accuse before Congress the President of the Republic; government ministers; members of the Constitutional Court; members of the Supreme Court; supreme prosecutors; Ombudsman and Comptroller General for violations of the Constitution and for any crime committed in the exercise of their functions and for five years after they have ceased to do so.
New ombudsman elected in May
Starting next Tuesday, May 9, a new Ombudsman will be elected in accordance with a new timetable approved by the Special Commission for the Selection of Suitable Candidates for the Election of the said Officer, chaired by MP Manuel García Correa (Alliance for Progress).
Garcia Correa said the new timetable has been extended by 15 calendar days and is intended to allow parliamentary groups to present their invited candidates.
Six congressmen voted in favor, none against, one abstained, and two congressmen who did not respond to a call for a vote to give the plenary session of the Congress of the Republic the authority to elect.
The face-to-face interview with each applicant invited for a suitable candidate is stage 16 and will take place from Wednesday 12 to Friday 14 April 2023.
