Coordinator Special Team Lava JatoRafael Vela, noted that there is no certainty that former First Lady Elian Carp will be able to face Peruvian justice because the only guarantee available is the issuance of her passport at the request of the United States government.
“All documentation is already in the possession of the US government (…). Carp, because there are no guarantees against her, only her status as a spouse in extradition through the Interoceanic. There their passports were requested and delivered. This is the only guarantee you have that she will not evade justice and that if the US government does not take some action, she may eventually go on a trip, ”he said in an interview for Trade.
“Not only in our opinion (Elian Karp must be detained in the US), but this is the decision of the Peruvian justice system. In the extradition process presented by the US v. Karp and Toledo in the Ekoteva case, there is also a request for provisional arrest. He is included in the extradition process itself (…). It remains in the hands of the North American authorities to evaluate the documentation they have and decide whether they should follow the same path as Toledo at that time, ”he added.
US court temporarily suspends extradition of Alejandro Toledo
Last Thursday, February 23, U.S. Judge Laurel Beeler temporarily halted Alejandro Toledo’s extradition process so he could return to U.S. soil to stand trial for alleged conspiracy and money laundering offenses.
The ex-president’s extradition has been put on hold for seven days or until the Ninth Circuit Court rules on habeas corpus filed by his defense and seeks to annul the entire process.
