Franciney Joaquim dos Santos was sentenced to prison after a transphobic speech
Franciney Joaquim dos Santos (MDB), councilor of the municipality of Coruripe, in Alagoas, was sentenced to prison. The politician received a sentence of 2 years, 4 months and 15 days after a transphobic speech.
On the occasion, the councilor said, in the plenary of the City Council, in April of this year, that trans women should “suffer a scratch” if they try to use the women’s bathroom.
With the conviction, Franciney will be able to appeal in freedom.
In addition, the politician must also pay 250 fine days, each worth one minimum wage.
“I do not agree with the decision of Justice, however, I respect the judgment. Judicial decision is fulfilled and respected”he told G1, informing that he does not intend to appeal, for now.
In his sentence, Judge Filipe Ferreira Munguba, responsible for the case, reported on the seriousness of the situation, claiming that, in addition to everything else, the defendant has a bachelor’s degree in law, that is, he knows the legislation.
“Therefore, when uttering hate speech, as a councilor, whose words have the potential to influence his voters and third parties, he revealed an intensity of malice that goes beyond the criminal type, and this circumstance must be valued in his disadvantage“, he said.
