The musicians used a photo of a naked four-month-old baby for the cover of their hit.
A US appeals court has reinstated rock band Nirvana’s publication lawsuit by Spencer Elden, whose childhood photo was featured on the cover of the 1991 hit Nevermind. The Guardian reported this.
Specifically, the man accuses the group of distributing child pornography.
Last year, a district court dismissed Spencer Elden’s lawsuit, saying the plaintiff waited too long to sue the iconic rock band.
However, yesterday, December 21, an appeals court said the man could still sue on the grounds that Nirvana later re-released the cover, along with the reissue of Nevermind in 2021.
Elden’s attorney said the man is “pleased with the decision and looks forward to his time in court.”
Elden, now 32, first sued the band in 2021, accusing Nirvana of sexual exploitation for including a childhood image of him on the Nevermind album cover. He sought compensation of $150,000 from each band member.

It was previously reported that the Teisco Del Ray EV-2T electric guitar, owned by the late Nirvana leader Kurt Cobain, will be sold at the Kruse GWS auction.
