From American Apple Inc. 13 billion euros will be recovered. And Google must pay a fine of 2.4 billion euros.
The European Court recognized the decision of the European Commission to recover from the American Apple Inc. as legal. 13 billion euros. CNBC reported this.
It was learned that the resolution was the result of a lawsuit that lasted 10 years. The European Commission began an investigation in 2014 and issued a decision to recover the specified amount in 2016, concluding that Ireland, where Apple’s European headquarters are located, had given the company unfair tax benefits for the period from 2003 to 2014.
In 2020, Apple, along with the Irish government, successfully blocked the recovery at the European Court of General Jurisdiction, which found that the EC had not proven that the company had been given an unfair economic advantage. However, on September 10, the highest court overturned the earlier decision and upheld the original conclusion of the European Commission.
The funds required by the European Commission are reserved in a special account pending the final judgment.
The European Court also ruled that the American company Google must pay a fine of 2.4 billion euros for abusing its dominant market position by maintaining its own comparison shopping service.
This case began in 2009, when the British company Foundem (the UK was still part of the European Union at the time) filed a complaint against the technology giant. The European Commission fined the company in 2017 following an antitrust investigation. The EC ruled that Google prefers the comparison shopping service to its competitors.
Google appealed the decision to the General Court of the European Union, which also upheld the fine. The company filed an appeal with the European Court.
The European Court said the Commission was right to consider Google’s behavior discriminatory and that the company’s appeal “must be rejected in its entirety.” In addition, Google and Alphabet must pay the costs incurred by the EC.
Recall that the European Commission fined Apple more than 1.8 billion euros for violating App Store rules for music streaming providers.
It was also reported that the French antitrust authority imposed a fine of 250 million euros on Google for failing to fulfill obligations to publications in the field of content licensing.
