Judge of the Supreme Court of Ukraine Alexander Volkov won the case against the Supreme Court again. Volkov was suing for more than UAH 14 million – this is a salary debt for 2021-2023.
Ukrinform reported this with reference to the decision of the Kyiv District Administrative Court and the Sixth Administrative Court of Appeal.
Volkov filed a lawsuit with the Ukrainian Armed Forces, in which he demanded compensation for two years of arrears of salary, a recalculation of his judicial remuneration for 2023, as well as payment of proper severance pay and other compensation related to the dismissal. The amount of claims exceeds UAH 14 million.
It consists of:
- debt in the amount of UAH 9281327;
- average earnings during the delay in payment upon dismissal (UAH 2,353,494);
- debt to pay wages from January to March 2023;
- compensation for unused vacation and severance pay (UAH 1,147,410).
Volkov noted that his right to receive payments due was violated due to the lack of recalculations and payments. Volkov refers to a letter from the Ministry of Finance, which confirms that the financing of judges of the Supreme Court of Ukraine is carried out within the budget allocations provided for by law.
He also recalled that the decision of the Constitutional Court in 2020 declared illegal the renaming of the Supreme Court of Ukraine into the Supreme Court without transferring judges, which affected its ability to continue working.
The Supreme Court filed a cassation appeal against the decision to pay Volkova compensation, but the date for its consideration has not yet been determined.
Volkov confirmed to Ukrinform that he is a plaintiff in this case and emphasized that not only he, but also several judges were removed from justice. This, he said, is contrary to European standards and has already been condemned by the European Court of Human Rights (ECHR).
The 2016 judicial reform deprived many experienced judges of the opportunity to administer justice. This is not only a violation of our rights, but also a question of the international image of Ukraine. Unfortunately, those responsible for these decisions have not yet been held accountable, the judge added.
