It was noted that in October alone, based on materials from the State Bureau of Investigation, courts in Lviv, Ivano-Frankivsk, Volyn, Transcarpathian and Ternopil regions made almost a hundred decisions not to arrest the military, but to allow they came back. in the service.
In particular, the Frankivsky District Court of the city of Lvov made a corresponding decision about a serviceman who, in March 2024, voluntarily left the location of a military unit in the Donetsk region.
During the pretrial investigation of the criminal proceedings, employees of the State Bureau of Investigation established the whereabouts of the military man and detained him. The detainee explained that he had been on the front line for a long time and simply could not handle the load, but he regretted what he did.
Considering that the serviceman committed such an offense for the first time and was ready to continue serving, the court decided to release him from criminal liability.
It was also reported that at the end of October the Vladimir-Volynsky City Court of the Volyn region released from criminal responsibility a serviceman who in November of last year voluntarily left a military unit stationed in Volyn. However, the man repented of his actions and received written permission from the commander of the military unit to reinstate him. Based on this, the court decided to release him from criminal liability.
As is well known, the unauthorized abandonment of a military unit or place of service, without good reason, committed in the circumstances of war, can be punished by imprisonment for up to 10 years. But first-timers in such a situation have a chance to return to the service.
We remind you that in the summer the Verkhovna Rada voted on a bill that proposed not to punish the first unauthorized departure from a military unit or desertion if the military person returns on his own and he is allowed of the commander to continue serving.
Earlier in the Carpathian region, a deserter was detained and suspected of boasting that he would never return to service and inciting other military personnel to flee.
