Volodymyr Zelensky, President of Ukraine, signed Law No. 3859-IX on the restoration of former military rank during martial law, which the Verkhovna Rada adopted on July 16.
The parliament’s press service reported this today, July 7.
“The main goal is to reinstate military personnel who were previously deprived of their military ranks as a disciplinary measure for exemplary performance of their official duties and combat missions in order to use their professional and organizational abilities, military and special training, and combat experience during martial law,” the statement said.
The explanatory note to the relevant bill noted that:
- junior and senior officers, as well as warrant officers (midshipmen), were subject to disciplinary deprivation of military rank;
- During the period of martial law, military personnel who have been deprived of their military rank and have not been deprived of or restricted in their freedom are awarded the military rank of soldier (sailor) by the commanders of military units, the official position of a military serviceman is announced for military service by conscription during mobilization, for a special period, and they are appointed to positions of privates. These military personnel continue to perform military service until demobilization is announced;
- at the same time, with the introduction of martial law, the appointment of officers to senior positions with a lower level of military education than that required by the passport of the military position is allowed. First of all, this is due to the shortage of high-quality officer personnel;
- At the same time, a number of military personnel who selflessly serve in the Armed Forces of Ukraine and other military formations, have a certain level of professional competence, education, experience of service in various types of positions and are motivated to liberate Ukraine from Russian occupiers, remain without attention due to the absence in the current Disciplinary Charter of the Armed Forces of Ukraine of a norm on the procedure for reinstating officers in rank in the event of the cancellation of a penalty.
Now this injustice has been corrected to ensure that the Armed Forces of Ukraine are staffed with professionally competent military officers with real combat experience, the initiator of the bill, MP Oleksiy Goncharenko, noted in his Telegram channel, commenting on the signing of the law by Zelensky.
