Ukraine has a legal regime of martial law, under which the holding of any elections is prohibited, the ministry emphasized.
“Elections” and “referendums” in the temporarily occupied territory are legally void, that is, invalid and do not create legal consequences. This was announced on Thursday, February 22, by the Ministry of Justice of Ukraine.
“Any elections and referendums held in the temporarily occupied territory, with the assistance or participation of state bodies and local governments established in accordance with the Constitution and laws of Ukraine, are invalid and do not create legal consequences,” emphasizes the Ministry of Justice.
The ministry reminds that the armed invasion, forced passports of citizens in temporarily occupied territories, the holding of elections in such territories and forcing citizens to participate in them is a grave violation of basic norms and principles of international law, expressed in a number of international documents. : the UN Charter, the Declaration of Principles of International law, the Helsinki Final Act of the Conference on Security and Cooperation in Europe of 08/01/1975, the Memorandum of Security Guarantee in relation to Ukraine’s accession to the Treaty on the Non – Proliferation of Nuclear Weapons on 12/05/1994, the Declaration on Principles of International Law Concerning Friendly Relations and Cooperation between States in accordance with the UN Charter (adopted by UN General Assembly Resolution 2625 (XXV) on October 24, 1970), the Geneva Convention of August 12, 1949 relative to the Protection of Civilian Persons in Time of War, IV Convention on the Laws and Customs of War on Land, relevant resolutions of the UN General Assembly.
It was also noted that since February 24, 2022, in Ukraine, in connection with the military aggression of the Russian Federation against Ukraine, a legal regime of martial law is in effect, in which the holding of any elections is prohibited.
On July 7, 2023, the Central Election Commission issued Resolution No. 43 On the illegitimacy of organizing the preparation and holding of any elections of the Russian Federation in the temporarily occupied territories of Ukraine.
It was previously reported that Ukrainian schoolchildren in Russian-occupied cities were forced to draw “Russian Federation elections” and campaign for Putin.
In the temporarily occupied part of the Luhansk region, the occupiers plan to hold presidential elections in three weeks.
