The US Supreme Court will consider the issue of disqualifying former President Donald Trump from the Republican Party’s internal party elections (primaries) based on a constitutional amendment that prohibits participation in “insurrection or insurrection .” This was reported by the Associated Press on Saturday, January 6.
In particular, the Supreme Court agreed to consider Trump’s appeal against the decision of the Colorado High Court, which, based on Chapter 3 of the 14th Amendment to the Constitution, prohibits him from participating in the primaries of the state due to the events of January 6, 2021 – the storming of the Capitol by supporters of the former president.
At the same time, the judges of the Supreme Court recognized the need to make a decision as soon as possible – the debates on the case will take place on February 8. That could allow the court to make its decision on the so-called “Super Tuesday” on March 5, when the largest number of primaries in states, including Colorado, will take place simultaneously.
So, for the first time, the US Supreme Court will consider the meaning and scope of the 14th Amendment to the Constitution, which was adopted shortly after the Civil War and largely unenforced thereafter. It prohibits officials who “engage in rebellion or sedition” from holding public office in the US.
The US high court’s decision to hear the case is its most direct intervention in a US presidential election since 2000, when a conservative majority of justices effectively ruled in Bush v. Gore on the victory of Republican George W. Bush.
The future decision of the Supreme Court will have a big impact on the 2024 US presidential campaign: It could kill Trump’s chances of being elected or, on the contrary, further embolden him and his supporters to call for attempts to demand the 14th Amendment as a “witch hunt. ” .
