The Colorado Supreme Court’s decision is unprecedented and could bar Trump from running for president. However, Trump promised to immediately challenge this decision in the US Supreme Court.
The Colorado Supreme Court on Tuesday, December 19, banned former President Donald Trump from participating in the Republican Party primaries pursuant to the 14th Amendment. While similar cases are pending in other states, Colorado became the first state to ban Trump from running for president because of his Jan. 6, 2021, charge that stormed the Capitol, The Hill reported.
The state’s high court, however, put the decision on hold until Jan. 4 so Trump could first appeal to the Supreme Court. At that time, his name will remain on the ballot.
Lawsuits challenging Trump’s participation in the upcoming election have been filed in more than 25 states ahead of the 2024 election. The Colorado case, brought at the request of six voters, is the biggest threat to his campaign.
Trump will likely try to challenge this decision in the US Supreme Court. Stephen Cheng, a spokesman for the Trump campaign, blamed the decision on a court “appointed by all Democrats” and vowed to immediately appeal the decision to the US Supreme Court. All seven Colorado Supreme Court justices are appointed by Democratic governors.
The Colorado case rested on the Third Section of the 14th Amendment. The provision was intended to prevent those who had sworn an oath to support the Constitution and participated in the insurrection from holding state or federal office.
