The NACP analyzes the information from the received message about the actions of the judge in the conditions of a real conflict of interest.
The National Agency for the Prevention of Corruption has developed protocols on administrative offenses against acting. “The information from the received message about the judge’s actions in the conditions of a real conflict of interest is verified,” the statement said.
It is noted that in order to confirm or refute this information, the NACP sent a request to the Constitutional Court requesting copies of relevant documents, but the head of the secretariat of the Constitutional Court refused to provide the requested documents .
In this regard, the NAPC issued an acting The Chairman of the Constitutional Court Sergei Golovaty had a mandatory order to follow, which was also ignored. Instead, the National Agency received a letter from the Constitutional Court about appealing the order to the administrative court. At the moment, there is no information about the court opening proceedings on this claim and making decisions to stop the execution of the order.
It was also reported that under similar circumstances, at the request of the National Agency in 2019-2020 (as part of events that did not concern Sergei Golovaty), the KSU provided similar documents. Moreover, such documents were provided by letters, in particular, signed by Sergei Golovaty.
The department reminds that failure to provide information at the request of the NACP, as well as failure to comply with the requirements set forth in the order, is an offense related to corruption.
Considered by action The Chairman of the Constitutional Court receives repeated orders issued by the NACP, in accordance with the requirements of the procedure for issuing orders of the National Agency for the Prevention of Corruption.
“If the court finds Golovaty guilty of committing this crime, information about him will be entered into the Unified State Register of Persons who have committed corruption and corruption-related offenses,” the statement said.
