Ukraine has been working for a year now to pay Russia in full for its future aggression. For this, a unique compensation mechanism was created. Deputy Minister of Justice Irina Mudraya said this on the air of the telethon.
He recalled that Russia did not recognize that there was a war and called it a “special military operation.”
“Last year, during the work of the negotiating group, in which I also took part, the discussed peace agreement was about reparations – although Russia did not want to hear about any compensation. The only thing that they were preoccupied with the removal of sanctions. Therefore, in the conditions of the existence of the authorities that are now in Russia, it is impossible for Russia to talk about voluntary reparations at all. Only forced,” said Mudraya.
According to him, Ukraine was forced to offer our partners a unique compensation mechanism.
“Because we are not talking about reparations, we do not have a country that has lost. We do not have a peace treaty, we do not have a neutrality treaty. So we have to create a mechanism for receiving compensation. This is what the country did last year, and this is the result “We received in November 2022 during the voting of the UN General Assembly, where a resolution on reparations to Ukraine was adopted. It was in May, in Reykjavik, an agreement was signed on the creation of the Register of Losses. This is the first stage in receiving compensation,” said the Deputy Minister.
Wise emphasized that the amount of future compensation from Russia continues to grow. And what the Lviv School of Economics in cooperation with the World Bank officially presented in October 2022 is this amount (direct damage) – $450 billion.
“If we initially acquire Russian assets without Russia’s consent, we still have to pay the difference. The difference will be settled, and it will be recorded by the Register of Losses, which we are launching today and which is located in the Netherlands ,” he says.
Irina Mudraya also explained the difference between Ukrainian and international loss registers: “There is a difference between Ukrainian and International registers, because Ukrainian registers are only damage caused by housing – material damage suffered by a person from the loss of property. International will be broader, more comprehensive, and it will include compensation not only for material damage, but also for damage caused to health, damage from torture, sexual assault, deportation, murder . The international register shall contain categories of claimants.”
He assured that the international registry will cooperate with the Ukrainian registry.
“Any registers have been created, but now we have the Deed, the Register of Damage, Lost Property, the exchange of information will be established. An individual can apply both Ukrainian and International at the same time,” Mudraya noted.
According to him, the Ministry of Justice, as the manager and head of the project, will say how, when, how, what evidence base will be included. Educational work is carried out on the International Register and its use, and provides free legal assistance.
“Citizens, states, and legal entities can apply to the register. A separate procedure will be done in accordance with the standards of international law and with our international partners,” Mudraya summed up.
It will be recalled that on May 17, within the framework of the summit of the Council of Europe in Reykjavik, the capital of Iceland, a political declaration was signed on the creation of a Register of damage caused by the Russian aggression against Ukraine.
