The new court ruling only concerns Ukrainian flags and military music – Russian ones remain banned.

Berlin’s Administrative Court lifted the ban on placing Ukrainian flags at the site of Soviet memorials in the districts of Treptow, Tiergarten and Schoenholzer Heide. This was announced the night before by Berlin broadcaster rbb, citing the Ukrainian organization Viche, which appealed the ban.

The court ruling said the Berlin police’s decision to jointly ban the Russian and Ukrainian flags was “clearly illegal” and that it did not provide “any evidence that public safety was at risk.”

Viche’s lawyer Patrick Heinemann emphasized, in a comment to rbb, that the administrative court of Berlin confirmed the legal position of the Ukrainian society.

“The ban on Ukrainian flags is – according to the court – clearly illegal. Anyone who uses his fundamental right to publicly express support for the Ukrainian people and their historical victims in the victory against the National Socialism does not threaten public safety,” he explained.

The Berlin police can appeal the decision of the Administrative Court to the Higher Administrative Court of Berlin-Brandenburg.

Recall, yesterday it became known that the Berlin police on May 8 and 9 prohibited to hang the flags of Ukraine and Russia near the Soviet monuments, as well as to turn on the marching music to ensure that “it is appropriate to honor the memory of the fallen soldiers of the then Soviet army.” The police also banned “utterances that, given the current situation, could justify, glorify or glorify the war in Ukraine.”
