Texas federal judge Matthew Kachmarik, today ordered that the drug’s approval by the Food and Drug Administration (FDA) be withdrawn in 2000. In other words, it issued a ruling removing the nationwide approval of the abortion pill mifepristone.
The ruling, however, gives the legal representatives of the government Joe Biden a period of one week to appeal the decision.
In the court text, the judge argues that the FDA violated due process in approving mifepristone and did not take into account the drug’s “bad health effects” on people who take it.
“The FDA has not fully addressed an important aspect of the issue by missing out on any evaluation of the drug’s psychological effects or evaluation of its long-term medical consequences,” Judge Kaczmarik wrote in the document.
Criticism after the judgment
FDA approved the use of mifepristone as an abortion method in 2000. Along with misoprostolThese two drugs are known as “abortion pills” or medical abortion.
Vice President Kamala Harris, who championed reproductive rights in government BidenAccording to him, the decision of the court creates a “dangerous precedent”.
“Allow courts and politicians to inform the public FDA what to do,” Harris told reporters in Tennesseereported by the American media.
Planned Parenthoodthe largest network of fertility clinics in the US, dismissed the decision in a statement, calling it “an unprecedented and highly disruptive move.”
“Today’s decision by a judge in Texas to block FDA approval of mifepristone is outrageous and shows how the court system is being used as a weapon to further restrict abortion nationwide,” the organization’s president said in a statement.
For its part, the conservative organization Alliance for Freedomwhich filed the lawsuit from which the ruling stems, hailed the measure as a “significant victory” for physicians and medical associations who opposed the FDA’s approval.
“By illegally approving dangerous abortion drugs, the FDA has put women and girls at risk, and it’s time to hold the agency accountable for its reckless actions,” the organization said in a statement.
Because the Supreme Court from USA reversed Roe v. Wade, who advocated access to abortions nationwide last June, use of the two pills has increased, according to the Guttmacher Institute.
Medical abortion accounted for 54% of all abortions in the country in 2022, according to a report from the organization.
