The High Council of Justice will examine complaints against Oksana Sofilkanich, considering the case of rape of a 14-year-old girl in Transcarpathia.
The High Council of Justice responded to the shocking verdict on three minor rapists of a 14-year-old girl in the Transcarpathian region, passed by the judge of the Volovets district court, Oksana Sofilkanich. The press service of the VRP reported that they will review the registered complaints against the judge.
The High Council of Justice assured that they share the concern of the public, journalists and authorized persons of the authorities regarding the objectivity of the pre-trial and judicial investigation in the case, as well as the fairness of the punishment set by the court.
At the same time, the VRP said that they can only act based on, within the powers and in the manner established by the Constitution and laws of Ukraine. They also added that the Supreme Court of Justice does not have the authority to intervene in the consideration of court cases, to assess the evidence in the case, to review the legality and validity of court decisions in an extra- procedural way, to comment on them.
“Checking the legality and validity of the court’s decision is exclusively within the competence of the court of higher instance, in this case the court of appeal. The judgment of the court of first instance does not enter into force and may be appealed,” the High Council of Justice Mentioned.
The prosecutor’s office will challenge the verdict in the manner prescribed by law. At the same time, the Supreme Court of Justice has no right to initiate the issue of opening a disciplinary case on its own initiative based on media reports about the presence of signs of a disciplinary violation in the actions of a judge.
“The registered complaints about the commission of a disciplinary offense by the judge of the Volovets district court of the Transcarpathian region Sofilkanich OA and the judge’s reports of interference in his activities as a judge during the administration of justice will be verified, they are will be given. an appropriate assessment in the manner prescribed by law,” summarized the High Council of Justice.
It will be remembered that in 2021 in Transcarpathia, three teenagers raped a 14-year-old girl in the basement and filmed it. The court decided the case only in March of this year. He sentenced the defendants to five years in prison, but released them from punishment, assigning a probationary period of two years.
The situation received wide publicity. The case was taken under the personal control of Ombudsman Dmitry Lubinets.
