Since the beginning of a full-scale war in Ukraine, trademarks have begun to appear that exploit the theme of war or protection from Russian aggression. In particular, Azovstal radish, Chernobaevka lemonade, Buchaya Kombucha drink and women’s tights with the inscription “AFU” appeared on the market.
Such frequent use of the war theme has drawn criticism among Ukrainians, especially when the marketing exploited names that are associated with tragedies. On March 20, a draft law appeared in the Verkhovna Rada providing for restrictions on the registration of trademarks and advertising.
The deputies propose to prohibit mentioning military events, settlements affected by Russian aggression, official greetings of the Armed Forces of Ukraine, names of units of the Defense Forces, military equipment and weapons in the names of trademarks.
The office of the President of Ukraine reacted to the use of the theme of the Armed Forces of Ukraine, the defense of the country and symbols of repelling Russian aggression in advertising and trademark names. They say that they are already preparing changes to the legislation in this area.
Andriy Smirnov, deputy head of the President’s Office, told Obshchestvenny that in the Public Office “there is no limit to indignation when you read about a proposal for hair removal against the backdrop of our military and under the slogans of helping the Armed Forces of Ukraine, or when you come across drinks, including alcoholic drinks, whose names use the names of cities in Ukraine whose history is full of not only heroism, but also tragedy.
Smirnov met with the State Food and Consumer Service and the Ukrainian National Office of Intellectual Property and Innovation. These regulators are responsible for protecting consumer rights and advertising and intellectual property.
According to Smirnov, during the meeting, it was agreed on March 27 to launch hotlines in both structures, including in territorial bodies, for prompt response to such cases.
We also decided to start preparing changes to the legislation. We are talking about norms that provide a quick and understandable process of the state’s preventive response to cases of dysfunctional activities that violate the norms of public morality. Also, these changes will imply an increase in liability for such violations, – the Public Office quoted the official as saying.
