Lanet Set company filed a complaint with the Antimonopoly Committee against media groups 1+1 media, Media Group Ukraine, StarLightMedia, InterMediaGroup of abuse.
The Supreme Court, following a lawsuit filed by Set Lanet, ordered the Antimonopoly Committee to consider the company’s application regarding the abuse of the monopoly position of the largest Ukrainian media group, reports Detector.media with relation to the court’s decision in case no. 910/ 13222/21.
Lanet appealed to the Antimonopoly Committee with accusations of 1+1 media group, Media Group Ukraine, StarLightMedia, InterMediaGroup of abuse, in particular, that they agreed to introduce the package sale of famous and not popular programs, coordinated their actions and unilaterally terminated contracts with some providers.
The company also accused media groups of abusing the collective monopoly, as a result of which they filed demands with providers regarding the cost of the tariff package for subscribers.
In March 2021, the named media groups sent a message to the Network Lanet provider about their desire to terminate the contract ahead of schedule.
AMCU noted that the Lanet network’s application did not meet the requirements of the law and did not contain copies of documents that would confirm the facts stated in the application. The Committee refused to consider the application on its merits, so the provider applied to the Economic Court, which in January 2022 ruled in Lanet’s favor and ordered AMCU to conduct an investigation.
On appeal, this decision was overturned, and on January 19, in Lanet’s cassation appeal, the Supreme Court ordered AMCU to consider a complaint against media groups about the abuse of a monopoly position. Lanet reported that after receiving the Supreme Court’s decision, the committee should immediately resume the mechanism for considering the application.
In addition, Lanet is preparing to file separate claims against each of the four media groups for damages due to the termination of the contracts: the company estimated losses of UAH 30 million for all four groups of the media.
