The Commercial Court of Kyiv opened a bankruptcy case against PJSC Zavod Kuznya in Rybalsky (Kyiv) at the suit of Proctoremo Investments Limited (PIL, Proctoremo Investments Limited, Cyprus) for having a debt in the amount of UAH 83.3 million when buying Land. Development LTD Plus LLC. This was reported by Interfax-Ukraine.
According to court materials released by the publishing agency, the decision to open a bankruptcy case was accepted by the court on December 19, 2022.
According to the Applicant (PIL), Zavod Kuznya in Rybalsky owes a total amount of UAH 83 million 300,370 thousand, including UAH 83 million 215,260 thousand of principal debt. The said debt arose on acquisition of 70% stake in LLC Land Development LTD Plus from PIL. At the same time, the plant, in a letter dated November 29, 2022, announced that it recognizes the debt, but does not have the funds to pay it.
The court, by its decision, recognized the existence of a debt from the plant in the amount of UAH 83.3 million, imposed a moratorium on the satisfaction of creditors’ claims, initiated a procedure for disposal of the property of debtor, appointed the arbitration manager of the enterprise Serhiy Boyarchukov and ordered him to provide information on the results of consideration of creditors’ claims on February 8, 2023 . The court also set a deadline of February 20, 2023 for an inventory of the debtor’s property.
A preliminary court hearing is scheduled for February 27, 2023.
