Yesterday, Sunday, the municipality of San Isidro released a statement indicating that the Ministry of Housing, Construction and Sanitation (MVCS) Draft Ordinance “Public Housing” “it’s not feasible” in your jurisdiction.
Municipality of Sanisidrino led by a mayor Nancy Vizurraga Torrejon (People’s Renewal) pointed out that “municipalities are responsible for planning what is best suited to ensure the quality of life in their territories.”
“For this reason, the final approval of projects involving social housingbecause they would violate joint residential our area,” the statement said.
“Infrastructure not guaranteed”
The community of Sanisidrina reported that the project MVCS does not guarantee the “providing infrastructure” of the specified social housing and that it “opposes” the ministry’s own sectoral policies and the Sustainable Urban Development Act.
“In which special attention is paid to planning work and its tools, especially if said public interest projects do not guarantee the provision of equipment and service infrastructure so that they do not generate Negative consequences in the environment in which they will be inserted.
Finally, the municipality of San Isidro affirmed that its obligation is to “use all available regulatory and legal mechanisms” in order to “ I respect to a residential building” of the specified area.
The dispute is not recent
In October 2020, the municipality of Sanisidrino through its then mayor augusto caceres, filed a conflict of jurisdiction claim with the Constitutional Court (CC) against Ministry of Housing cancel the supreme decree encouraging and incentivizing construction social housing in urban areas.
According to the lawsuit, the executive’s position “contradicts the quality of housing in an area organized and structured on the basis of homogeneous urban areas”, “contributes to the depreciation of housing units at the apartment level, which today have a high commercial value” and “distorts the ordering and planned development” jurisdiction.
In addition, according to the commune of San Isidro, MVCS was contrary to the four articles of the Special Rules for Urban Development and Construction, concerning the parameters of development and construction, to promote construction social housing on the size of apartments and the height of buildings under construction.
However, in October 2021 CT declared unfounded the claim filed by the mayor of San Isidro with the votes of the then justices of the peace Marianella Ledesma, Eloy Espinosa-Saldanha And Manuel Miranda.
The decision of the TC stated that there was no violation of powers, since they should be regulated by what is established by the governing body in the case, which is MVCS. In this sense, they emphasized the position of the ministry as “the leading body of state and sectoral policy in the field of housing construction.”
In addition, the proposal states that some general parameters can be made more flexible in order to reduce costs and maximize the space for promotion. social housing, which are government solutions to reduce the housing gap.
