The Ombudsman’s Office, in its latest oversight report ahead of the 2022 regional and municipal elections, indicated that more than 800 polling stations out of 2,078 commissioners across the country election campaign nearby, just a day before the election.
The message indicates that until yesterday, Saturday, October 1, 882 polling stations outside they had panels, posters and other elements of political propaganda. Of these, only in Lima in such conditions there were 167 stores. Junin followed him with 78.
In order of incidence, Callao continued with 59 cases, Cusco with 58, Piura with 55 and Ayacucho with 50. This situation repeated itself in all regions of the country, with La Libertad and Amazonas having the lowest incidence, with 3 and 2 cases respectively.
Similar protection identified 9 polling stations across the country with electoral campaigning at their facilities, despite the fact that this is expressly prohibited by the electoral law. This situation was confirmed in two places in Cusco, while Ancash, Ayacucho, Ica, Junin, La Libertad, Lima and Puno presented one such case in their regions.
Prohibition in the electoral law
It should be noted that, as stipulated in Article 7 of the Electoral Law, political organizations cannot carry out election campaigning 24 hours before the elections.
For this reason, as stated Michelangelo Crossspecialist of the Control Department of the National Electoral Jury (JNE) in Andean agencypolitical parties are responsible for removing all elements of propaganda located on public roads and building facades.
“On Saturday, October 1, starting from 12:00 (…) the distribution of election campaigning is prohibited. Political organizations must now remove all advertisements they have placed on various streets in county, state, and state jurisdictions. First of all, we call on political organizations to begin to eliminate the propaganda that is in the vicinity of polling stations,” he said.
In addition, he pointed out that “owners who have rented or donated to a candidate or political organization” their propaganda facades “should also proceed to remove said advertising elements, since the rule states that this is already prohibited.”
” JNE and other electoral bodies, the PPP and representatives of the public ministry, will conduct operations on (Saturday) in the vicinity of schools that act as polling stations in order to act in accordance with the norm and their functions,” the official said.
He added that the ban “guarantees the non-proliferation of election campaigning” and that “it is also considered in the Criminal Code as an electoral crime with a penalty of at least 2 years.”
Actions
Ombudsman indicated on RPP news that, in order to ensure compliance with the norm, at all polling stations where the indicated campaign was found, the heads of the indicated institution agreed with the inspectors Special Electoral Jury (JEE) to remove these items.
The National Police and Serenasgo County were also involved in this task. In addition, since yesterday, the Public Ministry, through the regional prosecutor’s office for the prevention of crime, launched the operation “Removing the election campaign” in accordance with the election regulations.
Similar protection pointed out that in these elections citizens could actively participate together with this institution in identifying threats or aspects that should be improved in the electoral process.
