The National Electoral Jury (JNE) declared inadmissible the vice imposed on the Podemos Peru candidate list, whose main figure is Daniel Urresti, al Municipality of Lima.
The reason for this action was the failure to comply with a formal requirement, namely the failure to provide proof of payment of the relevant removal rate in a timely manner.
According to the JNE, this process is set out in article 34, number 34.1 of the Registration Rules for Lists of candidates for the 2022 municipal elections. Consequently Special Electoral Jury (JEE) of Central Lima dismissed the appeal and ordered its final dossier.
Similarly, JNE argued that essential requirements were also not met because procedural actions of the electoral body are called into question and not a violation of any requirement that is in accordance with this political organization.
“The vice is not a way to question the proceedings of the SIO, who, using their legal powers and powers, act autonomously to verify that the requirements of the law are fully complied with and that candidates are not prevented from participating in the election campaign,” JNE points out.
Tacha v. Avanza País was also declared inadmissible.
Similar JNE plenary session declared it unacceptable to hit Mayor Surko against the Avanza País list because it did not mention a violation of any requirement to apply for public office.
“With this ‘Letter’, resolution 00215-2022-JEE-LIO3/JNE issued by JEE Lima Oeste 3 has been declared null and void, allowing the aforementioned flaw to be handled. In addition, he ordered the final file of the aforementioned file,” JNE reports.
