Former President Alejandro Toledo filed an urgent motion with a Colombian court this morning to stop the extradition process. This comes after Judge Thomas Hickson ordered him to turn himself in this Friday, April 21 at 11:00 am (Lima time) to US police.
“Please note that Dr. Alejandro Toledo’s lawyer hereby asks for a stay of his detention in the United States and extradition to Peru, pending the consideration and decision of the Court in respect of its pending Appeal for Review, 19 April 2023, ECF No. 14 (‘Request’) for a review of this Court’s ruling,” can be read in the document.
“For the above reasons, Dr. Toledo respectfully requests that this court stay his detention and extradition. until the court resolves the applicant’s appeal for review,” he continues.
The Minister of Justice assured that Alejandro Toledo could be available from the moment of his arrest.
On the other hand, Justice Minister José Tello mentioned that Toledo Manrique could be made available to the Peruvian authorities from the moment of his arrest. Subsequently, the procedure will remain in the hands of Minjus and INPE.
“From the moment of his detention, he can be placed at the disposal of the Peruvian authorities.. Mr. Toledo must report to the Peruvian justice system as soon as possible. Once he arrives in Peru, there is a procedure for which the Ministry of Justice is responsible. INPE accepts a man even after passing a forensic examination. He is put in jail. We can deduce that this is Barbadillo. Ultimately, this is decided by the INPE rating board,” he said in News extension from PTR.
