The Congress of the Republic, in a communiqué, defined the mechanism by which approve the promotion of the next regular legislature for 2022-2023. which was originally supposed to start on March 1 this year.
As known, Constitutional Commission Parliament approved last Tuesday moving the said legislature to 15 February next year to ratify the reduction in mandates Executive and Legislative and promoting general elections.
Considering this scenario, the parliament indicated that after the publication of the approved opinion on the portal Congress”7 calendar days” must pass before its discussion at the plenary session.
“Because this is a change to the Organic Law, the opinion must be discussed in plenary session after publication seven calendar days before, in accordance with Article 78 of the Regulations on the Law. Congress”, the message says.
This is because it is “an amendment to the Bylaws of Congress having the character organic lawTherefore, it cannot be exempted “from the period of publication” as stated in said ruling.
In this regard, the nomination of the legislature for February 15 can be discussed in the plenary session from February 2, “after the extension of the current legislature.” They add that during the course of the discussion, the proposed date could be determined or changed.
“During said debate, the National Representation may decide or change the date for the nomination of the legislature proposed by the Constitutional Commission to February 15,” the document states.
The current legislature ends on 10 February after being renewed by Parliament. This was announced by the head of Congress Joseph Williamswho indicated that this extension is being given to carry out necessary reforms to advance the April 2024 elections.
Constitutional Commission approves promotion of second legislature
Last Tuesday, the Constitutional Commission of the Congress approved with 15 votes in favor and 8 against the draft legislative resolution 4010/2022-CR, which proposes to nominate a second legislature to start February, 15 and ends June 15, 2023. This is done in order to expedite the vote in the second instance, which ratifies the project to advance the general election.
The initiative, originally presented by the Legislative Board of Directors, should go to the plenary session of Congress and be approved by at least 87 votes so that it can enter into force. It should be remembered that this project was promoted by the President of Parliament José Williams himself.
The approval of the project in a parliamentary working group chaired by Congressman Fujimori Hernando Guerra did not take into account the proposals of lawmakers such as Susel Paredes or decent streetwho indicated that it would be prudent to speed up the initiative and advance the legislature before 1 February.
Recall that the reason for this initiative is to speed up the vote on the draft of early general elections in response to protests that have taken place in different regions of the country demanding the resignation of President Dina Boluarte and the closure of Congress.
