Proposal by Ana Campagnolo (PL) seeks to restrict advertisements related to gender and sexual orientation for children and young people
The deputy in question is a well-known supporter of the movement led by the family from Rio de Janeiro known for always having to answer for something in court – including virtual attacks against trans people and transvestites.
If approved, the bill would impose fines ranging from R$20,000 to R$1 million for those who fail to comply with the rules, in addition to the possible closure of establishments until they comply with the requirements. The congresswoman’s justification argues that “children and adolescents are particularly sensitive to environmental influences” and that the bill seeks to “limit the broadcasting of advertising that encourages practices considered harmful.”
In April 2023, deputy Marcius Machado (PL), the initial rapporteur for the project, gave an opposing opinion, claiming unconstitutionality, after consulting entities such as the State Department of Education, the State Attorney General’s Office (PGE) and the State Council for the Rights of Children and Adolescents. However, the opinion was rejected and, after a request for review, deputy Pepê Collaço (PP) presented a new report, this time in favor of the ban.
The bill that attacks queer freedom is now awaiting consideration by the Finance and Taxation Committee. There is still no forecast for when the proposal will return to the agenda.
