The Public Defender’s Office of the State of Amazonas (DPE-AM), through the Office Specialized in the Defense of Human Rights, filed a lawsuit against the health plan operator Hapvida. The objective is to guarantee the right to gender identity of a trans man who has been suffering embarrassment for being called by his dead name by the company, even after his civil registration has been corrected.
The person being assisted, a customer since 2017, had his name corrected on his birth certificate in 2023. Since then, he has been requesting a change to his registration with the operator, without success. The company’s refusal to recognize their gender identity creates embarrassment and emotional suffering for men, who are forced to deal with the constant violation of their rights.
Public defender Elânia Nascimento, responsible for the case, highlights the situation of hypervulnerability of trans people in society, marked by prejudice and discrimination in various areas, including the job market and social acceptance.
The legal action seeks not only to repair the moral damage caused, but also to serve as an instrument of awareness and education about the rights of the LGBTQIAP+ community. “Compensation also represents a pedagogical issue, so that trans people can believe in themselves, in the Judiciary and in guaranteeing the preservation of their rights”, says Elânia.
