The Federal Prosecutor’s Office for Citizens’ Rights (PFDC) stated that the initiative is a setback
The Federal Attorney’s Office for Citizen’s Rights (PFDC), an agency of the Federal Public Ministry (MPF), sent a note with the request to reject and archive the bill, known as PL, which seeks to prohibit same-sex marriage in Brazil. The PL is under analysis in the Chamber of Deputies.
According to the PFDC, the initiative is contrary to international principles and is considered a setback in the fundamental rights and guarantees of the LGBTQIA+ community, in addition to being unconstitutional.
The Prosecutor’s Office stated that denying the possibility of a union recognized before the Court implies saying that homosexuals have fewer rights than heterosexuals. In this way, a hierarchy is created based on sexual orientation, which goes against constitutional precepts.
“This idea collides head-on with the essence of the Constitution of the Federative Republic of Brazil, which seeks to structure a nation in which coexistence between different people is peaceful and harmonious”, said the note.
The PFDC said that this PL presents a setback and that it seeks to remove the rights of the LGBTQIA+ community.
“A possible approval of this project does not only mean that the State assumes that there is a correct model of marriage and that this model would be heterosexual. It also means that the State recognizes non-heteronormative people as citizens and second-class citizens, who cannot exercise all their rights, depending on their sexual orientation”, said the document.
